Overview 

1935 Fleet’s merchandise return and refund policy lasts 30 days. If 30 days have passed since your purchase, we can’t offer you a full refund or exchange. 

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. 

Each artist on 1935fleet.com has the right to set their own return and refund policy. However, 1935 Fleet holds the final decision on all returns and returns. You may inquire directly for additional questions or disputes at [email protected] 

To complete your return, we require a receipt or proof of purchase. Additionally, on all returns, you must send a direct email to [email protected] for more information on a return address. 

Refunds 

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. 

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days. 

Late or missing refunds 

If you haven’t received a refund yet, first check your bank account again. 

Then contact your credit card company, it may take some time before your refund is officially posted. 

Next contact your bank. There is often some processing time before a refund is posted.

Exchanges

We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at [email protected] 

Shipping returns 

To return your product, you should email a brief description to [email protected]

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. 

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

Intellectual Property Policy and DMCA

This policy should be considered as part of our Terms and Conditions.

1935 Fleet is a marketplace of third-party sellers who operate their own shops and are responsible for complying with applicable laws. While we provide the marketplace, 1935 Fleet does not manufacture or ship third-part sellers products. The content uploaded on 1935 Fleet’s marketplace is created by such sellers who are not employees or agents of 1935 Fleet. Sellers are responsible for all content uploaded to the marketplace.

When we are notified of an IP infringement, 1935 Fleet’s goal is to respond as quickly as possible by removing the allegedly infringing material in question. When 1935 Fleet removes content because of a notice, 1935 Fleet uses great measures to contact the member affected by the infringement claim and provide information about the notice and removal. Information regarding the IP owner’s alleging infringement may also be provided.

1935 Fleet reserves the right to remove any piece of content, page, shop, or entire account that we believe violates our Terms of Service (ToS) in addition to this IP policy. 1935 Fleet also reserves the right to take action against those who abuse our IP policy or our ToS.

Before removing any material, 1935 Fleet may ask for additional information relating to the claim. Notices or counter notices may be rejected by 1935 Fleet if we believe the information contained therein is incomplete, false, fraudulent, or otherwise submitted in bad faith.

At 1935 Fleet discretion, members who repeatedly infringe the IP policy may have their privileges and access to the marketplace suspended or terminated by 1935 Fleet. 1935 Fleet reserves the right to terminate an account and access to our services at any time, for any reason, and without any advance notice.

If you are the intellectual property owner or the authorized representative who submitted a claim, 1935 Fleet will accept a withdrawal from you if the withdrawal clearly states that it is a formal withdrawal and clearly identifies the affected member and/or content. This can be done by providing the username, page/shop name, or the 1935 Fleet URLs.

Upon receiving a formal withdrawal, 1935 Fleet will make reasonable attempts to contact the involved parties to confirm receipt from the submitting party and to inform the affected member of the withdrawal. However, a withdrawal does not guarantee any change to the affected member’s shop status. These will be reviewed on a case-by-case basis

To submit a notice of infringement under the Digital Millennium Copyright Act (DMCA), you will need to comply with the following procedures:

Notices of infringement must be sent via email [email protected] and each notice must include all of the following information:

  1. The name of the copyright owner
  2. Identification of the work in which the copyrights are allegedly infringed
  3. Identification and location of the allegedly infringing material on 1935 Fleet website,
  4. A statement by the notifier that the notifier has a good faith belief material is not authorized by the copyright owner, its agent, or the law
  5. A statement that the notice is accurate and under penalty of perjury the notifier is authorized to make the complaint on behalf of the copyright owner
  6. A signature of a person authorized to act on behalf of the copyright owner. Electronic signatures are accepted.

If you believe that your content or other material was removed/disabled because of a misidentification or mistake, including a good faith belief that the content or other material does not infringe the notifier’s rights, you can send a counter notice via email to [email protected]. It must include all of the following:

  1. Identification and location of the work that is the subject of the infringement allegations
  2. A statement made under penalty of perjury that you have good faith belief that the material was removed because of a mistake or misidentification including because the allegations were without merit
  3. Your name, email address, address, and telephone number
  4. A statement that you consent to the jurisdiction of the Federal Court for the judicial district in which you are located, or if your address is located outside the United States, for any judicial district in which 1935 Fleet is located, and that you will accept service of process from the person who provided the original notification or an agent of such person
  5. Your signature that can be provided electronically

By moving forward, vendors agree to the following terms:

  1. 1935 Fleet LLC will obtain 12.5% of the final sales price, including shipping.
  2. Vendors will add “Member of 1935 Fleet” and the URL/link to their respective shop page in the bio of their social media accounts.
  3. 1935 Fleet LLC will pay out vendors every week on Sunday directly to their bank account associated to the website
  4. Vendors will be responsible for all shipping costs and determining processing times.
  5. Vendors agree to first attempt to resolve any disputes directly with a buyer.
  6. 1935 Fleet LLC reserves the right to issue a refund to a buyer if the product never arrives or is deficient.
  7. Vendors will have the opportunity to contribute to official 1935 Fleet LLC merchandise on our future drops. If 1935 Fleet LLC decides to utilize their design we will give the Vendor 15% of net profits.
